This Privacy Policy explains how Rise Up Creations collects, uses, and shares information when you visit our website, submit an inquiry, book a session, access a client gallery, or participate in our student ambassador program.

It works alongside our Terms of Service, which appears alongside this policy in the footer of your client gallery and on our website.

1) Who we are and how to reach us

Rise Up Creations ("we," "us," "our") is a photography business owned and operated by Cass Rufus, based in Elmhurst, Illinois.

2) Information we collect

Information you give us directly

  • Contact information such as name, email address, phone number, and mailing address

  • Session details you submit, including service type, preferred dates, locations, referral information, and notes

  • Creative preferences you share, such as questionnaire responses, mood boards, and inspiration links

  • Names and ages of session subjects, including minors

  • Parent or guardian contact information when the client is under 18

  • Shipping and billing addresses for print and product orders

  • Signed agreements and related records

Information collected automatically

  • Gallery access activity through our gallery provider

  • IP address, device type, browser type, and operating system

  • Pages visited, time spent, and referring website, through standard logs and analytics

Photographs and video

Images and video captured during a session are personal information when they identify a person. We store, edit, and deliver these files as part of providing our services.

Payment information

Payments are processed through secure third party providers. We do not collect or store full payment card details or bank account numbers on our systems. Our payment providers may share limited details with us, such as the last four digits of a card, the payment amount, and the transaction status.

3) How we use your information

We use the information we collect to:

  • Respond to inquiries, provide quotes, and communicate about services

  • Book, plan, and photograph sessions

  • Deliver galleries, downloads, prints, and products

  • Manage bookings, contracts, invoicing, and client support

  • Administer our student ambassador program and communicate with participants and their parents

  • Send newsletters, promotions, and updates when you have asked to receive them

  • Display images in our portfolio and marketing, as described in our Terms of Service and your signed agreement

  • Improve our website, services, and client experience

  • Keep business records and meet legal, tax, and accounting obligations

  • Maintain security and prevent fraud or abuse

We do not sell your personal information. We do not share it with third parties for their own independent marketing purposes.

4) How we share information

We share information only as needed to operate our business, such as with:

  • Pixieset, which hosts our client galleries and online store

  • Service providers that host our website and handle forms, scheduling, email, and file delivery

  • Payment processors that handle invoicing and transactions

  • Print labs and product fulfillment providers that produce and ship your orders

  • Shipping carriers for delivery of physical products

  • Professional advisors, such as our accountant or attorney, when necessary

  • Legal authorities, when required by law, subpoena, or valid legal process, or to protect our rights, property, or safety

Each of these providers maintains its own privacy policy governing how it handles information.

If our business is ever sold or transferred, client information may transfer as part of that transaction. We would notify affected clients.

5) Client galleries and your privacy controls

Client galleries may be password protected. Depending on the settings selected for your gallery, you may have options to control the visibility of certain images, limit who can view or download them, and adjust sharing permissions.

If you would like your gallery set to a higher privacy level, or would like specific images hidden, contact us and we will adjust the settings for you.

You are responsible for keeping your gallery password private. Please do not post it publicly or share it on social media.

6) Children's and minors' privacy

Our website and services are not directed to children under 13, and we do not knowingly collect personal information online from a child under 13 without verifiable parental consent. If you believe a child under 13 has provided personal information to us, contact us and we will address it promptly.

We photograph minors as part of our sessions and our student ambassador program. When a client or program participant is under 18:

  • A parent or legal guardian must provide consent and enter into any agreement on the minor's behalf

  • We collect the parent or guardian's contact information as the primary point of contact

  • We collect only the information about the minor that we need to plan and deliver the session

  • A parent or legal guardian may request access to, correction of, or deletion of their child's information at any time

  • A parent or legal guardian may withdraw permission for promotional use of their child's images at any time by emailing us

We do not publish a minor's full name, school, home address, phone number, or other identifying details alongside their images without written parental permission.

7) Cookies and analytics

Our site and service providers may use cookies and similar technologies to keep the site working properly, remember your preferences, keep gallery sessions active, and understand how visitors use the site.

You can control cookies through your browser settings. Blocking cookies may affect gallery access and some site features.

Analytics services we use may set their own cookies and are governed by their own privacy policies.

8) Marketing communications

If you have opted in to our email list, we may send newsletters, session announcements, promotions, and mini session availability. Every marketing email includes an unsubscribe link.

Unsubscribing from marketing does not stop transactional messages related to your booking, such as invoices, gallery delivery notices, and session logistics.

9) Data retention

We retain information only as long as needed for business, legal, and operational purposes, including delivering galleries, providing support, maintaining records, and fulfilling orders.

  • Client galleries remain active for the period stated in our Terms of Service, after which images may be archived or removed

  • Image archives are retained at our discretion and are not guaranteed indefinitely

  • Signed agreements and contracts are retained for at least 10 years, which matches the Illinois statute of limitations for written contracts

  • Invoices, receipts, and financial records are retained for at least 7 years for tax and accounting purposes

  • Records relating to a client or session subject who was under 18 at the time of service are retained until at least two years after that person turns 18, or for the periods above, whichever is longer

  • Inquiry and marketing contact information is retained until you ask us to remove it

You are responsible for downloading and backing up your delivered images before your gallery expires.

10) How we protect your information

We take reasonable administrative and technical steps to protect personal information, including password protected galleries, secured devices and accounts, limited access to client records, and reputable third party platforms for payment and file hosting.

No method of transmission or storage is completely secure. We cannot guarantee absolute security, but we take the protection of your information seriously and will notify you if we become aware of a breach affecting your data, as required by law.

11) Your choices and rights

You may, at any time:

  • Ask what personal information we hold about you

  • Ask us to correct information that is inaccurate or out of date

  • Ask us to delete information we are not required to keep

  • Withdraw permission for promotional use of your images

  • Request removal of specific images from our public channels

  • Adjust the privacy settings on your client gallery

  • Unsubscribe from marketing emails

Depending on where you live, you may have additional rights under state or international privacy laws, including the right to know what information is collected, the right to request deletion, the right to opt out of the sale or sharing of personal information, and the right not to be discriminated against for exercising these rights. We do not sell or share personal information as those terms are defined under those laws.

To make a request, email riseupcreations@riseupwb.com. We will respond within 30 days and may need to verify your identity first. For a minor, requests must come from a parent or legal guardian.

12) Third party links

Our website, galleries, and emails may link to third party sites such as Pinterest, social media platforms, or vendor pages. We are not responsible for the privacy practices or content of those sites. We encourage you to review their privacy policies.

13) Social media

If you interact with us on social media, those platforms collect information according to their own privacy policies. Comments, messages, and tags you send us on those platforms are handled under the platform's terms, not this policy.

14) Changes to this policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be posted here, and we will make reasonable efforts to notify active clients by email.
