Rise Up Creations Client Gallery Terms of Service

By accessing or using the Rise Up Creations website, client galleries, or digital downloads (the "Services"), you agree to these Terms of Service. If you do not agree, please do not use the Services.
1) Who we are
Rise Up Creations ("we," "us," "our") is a photography business owned and operated by Cass Rufus, based in Elmhurst, Illinois.

2) Age and parental consent
The Services are intended for use by adults. If a client, session subject, or program participant is under 18 years of age, a parent or legal guardian must review and accept these Terms on their behalf.
The parent or legal guardian is responsible for gallery access, for how delivered images are used and shared, and for submitting any request regarding image removal or usage rights. Where these Terms give a right or responsibility to "you" and the client is a minor, that right or responsibility belongs to the parent or legal guardian.
3) Client gallery access and passwords
Client galleries may be password protected. You are responsible for keeping your access details private and for any activity that occurs through your access. Please do not share gallery passwords publicly or post them on social media.
If you believe your gallery access has been shared without your permission, contact us and we will reset it.
4) Gallery availability, downloads, and backups
Online galleries remain active for 60 days from the date of delivery. You are responsible for downloading your images and keeping your own backup copies before the gallery expires.
Once a gallery expires, images may be archived or removed from the platform. Archived galleries may be restored at our discretion, and a retrieval fee of $50 may apply. We do not guarantee indefinite storage of any files, and we recommend saving your images in at least two places once you receive them.
5) Copyright and ownership
All images, designs, and content displayed in our galleries are copyrighted and owned by Rise Up Creations unless stated otherwise. Access to a gallery does not transfer ownership or copyright.
6) Personal use license for digital images
Unless your signed service agreement states otherwise, digital images delivered to you are licensed for personal, non commercial use only. This includes:
Personal printing for your home
Sharing on personal social media with no commercial intent
Sharing with family and friends for personal enjoyment
You may not, without our written permission:
Sell, license, or commercially use images
Submit images to contests, publications, or vendors for promotional use
Alter images heavily, apply filters that change the look, remove watermarks, or edit out branding
Use images for AI training, scraping, or automated collection
Claim authorship of the images
If you need school, team, brand, or business usage rights, please request a commercial license and we will be glad to discuss it.
When you share images online, we appreciate a tag or credit to Rise Up Creations. It is not required, but it helps us and we are always grateful for it.
7) Our use of images
Rise Up Creations retains the right to use images from any session for portfolio, website, blog, social media, print samples, studio displays, marketing, and advertising purposes.
If you prefer that your images not be used this way, email us at the address above and we will honor that request going forward. For clients under 18, this request must come from a parent or legal guardian. Requests apply to future use, and we will make reasonable efforts to remove images already published on channels we control.
Program participants who have agreed to specific promotional or ambassador terms in a signed agreement are governed by that agreement.
8) Sharing and social media
You may share images online for personal use as described in Section 6. Please do not share gallery passwords publicly.
If you would like certain images removed from public view, email us at the address above with the image or gallery details. We will remove the images from channels we control within 5 business days. We cannot control images that have already been downloaded, reshared, or saved by others, and we cannot guarantee removal from third party sites or search results.
9) Orders, products, and fulfillment
If prints or products are purchased through an online store, pricing, taxes, and fulfillment timelines are shown at checkout. Third party labs or service providers may fulfill print products. Color may vary between screens and printers, and we cannot guarantee an exact match to what you see on your device.
Because prints and products are made to order, they are not returnable. If your order arrives damaged, defective, or incorrect, contact us within 10 days of delivery with photos and we will arrange a reprint or replacement at no cost to you.
10) Third party platforms and services
Our galleries, online store, scheduling, and payment tools are hosted by third party providers. Your use of those tools is also subject to the terms of service and privacy policies of those providers. We are not responsible for the acts, omissions, outages, or data practices of third party platforms.
11) Availability and site functionality
We aim for reliable access, but galleries and downloads may be temporarily unavailable due to updates, outages, maintenance, or platform issues. We are not responsible for interruptions beyond our control. The Services are provided on an "as is" and "as available" basis.
12) Prohibited conduct
You agree not to:
Attempt unauthorized access to galleries, accounts, or systems
Copy, scrape, or download images in bulk
Circumvent password protection, watermarks, or download restrictions
Use the Services to harass, infringe rights, or violate any law
Interfere with the security or proper functioning of the Services
13) Suspension of access
We may suspend or terminate gallery access if these Terms are violated, if access is being shared improperly, or if an account has an outstanding unpaid balance. Where practical, we will contact you before suspending access and give you an opportunity to resolve the issue.
14) Indemnification
You agree to indemnify and hold harmless Rise Up Creations, and its owner and representatives, from any claims, damages, losses, or expenses, including reasonable attorney's fees, arising from your use of the Services, your use or distribution of delivered images, or your violation of these Terms or the rights of any third party.
15) Limitation of liability
To the fullest extent allowed by law, Rise Up Creations is not liable for indirect, incidental, special, or consequential damages arising from your use of the Services. Our total liability for any claim related to the Services will not exceed the amount you paid to us for the specific service giving rise to the claim.
16) Agreements and precedence
These Terms apply to your use of our website, client galleries, and digital downloads.
Session bookings, retainers, payment schedules, cancellations, rescheduling, program participation, and delivery timelines are governed by your signed service agreement. Where these Terms and a signed agreement conflict, the signed agreement controls.
17) Privacy
Our collection and use of personal information is described in our Privacy Policy, which appears alongside these Terms in the footer of your client gallery and on our website. By using the Services, you agree to the practices described there.
18) Changes to these Terms
We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Your continued use of the Services after changes are posted means you accept the revised Terms. For material changes, we will make reasonable efforts to notify active clients by email.
19) Governing law, venue, and fees
These Terms are governed by the laws of the State of Illinois, without regard to conflict of law rules. Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in DuPage County, Illinois, and you consent to that jurisdiction and venue.
In any action to enforce these Terms, the prevailing party is entitled to recover reasonable attorney's fees and costs.
20) General provisions
Severability. If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect.
Entire agreement. These Terms, together with any signed service agreement and our Privacy Policy, make up the entire agreement between you and Rise Up Creations regarding the Services.
No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
Assignment. You may not assign or transfer these Terms or any rights under them without our written consent.
Headings. Section headings are for convenience only and do not affect interpretation.
